Overview of drone regulations in Virginia (VA). In addition to federal FAA rules that apply everywhere in the US, Virginia has state-specific laws governing drone operations, privacy, and restricted areas.
Key State Laws
VA Code § 19.2-60.1 (2015)
Restricts law enforcement drone use. Establishes civilian drone privacy protections.
VA Code § 18.2-121.3 (2016)
Prohibits using drones for peeping or surveillance.
Restrictions
- No using drones for peeping or surveillance without consent
- Washington DC FRZ extends into Northern Virginia — strict no-fly zone
- Pentagon, CIA, and military installations create extensive restricted airspace
- No flying near critical infrastructure
Penalties
Class 1 misdemeanor for peeping; up to 12 months jail and $2,500 fine
Local Flying Notes
Northern Virginia is heavily restricted by the DC FRZ. Flying is prohibited within 15 miles of Reagan National Airport. Central and southern Virginia have much more flexibility. Virginia Beach and Richmond have FPV communities.
